INSTITUTING LEGAL ACTION

You may not institute any legal action to recover money or obtain benefits with respect to any claim unless and until you have first exhausted all of your appeal rights under the Plan. In addition, under no circumstances may any legal action be commenced or maintained against the Plan, the Fund, the Trustees, or any employee or representative of the Plan or Fund more than ninety (90) days after the Board of Trustees advises you in writing of its final decision on review of the claim.
