TRUSTEES
Dear Participant:
We are pleased to provide you with this Summary Plan Description (“SPD”)
describing the program of benefits (the “Plan”) available
under the Teamsters Local 805 Welfare Fund (the “Welfare Fund”
or “Fund”). This document, which serves as the SPD and Plan
Document, is being furnished to you so that you will be aware of all of
the benefits provided by the Fund for you and your eligible family members.
The Fund is a multiemployer health and welfare plan, which is jointly
administered by Employer Trustees and Union Trustees. The Fund has been
established, and is maintained and operated, in accordance with certain
official Fund documents, such as the Trust Agreement, and the rules, regulations
and policies of the Fund adopted by the Board of Trustees, agreements
with insurers and other service providers to the Fund, collective bargaining
agreements, etc.
The primary purpose of this SPD is to provide you with a non-technical
explanation of the important features of the Plan. It is supplied solely
for the purpose of assisting you in comprehending the scope and meaning
of your benefits. The SPD does not change, replace or interpret the terms
of the official Fund documents. This SPD describes the benefits in place
as of January 1, 2007.
This SPD also contains important administrative information, such as how
to file a claim for benefits from the Fund, and explanations as to what
your benefits are. You should refer to this SPD whenever you need information
about your benefit coverage, and be sure to share it with your family.
If you lose or misplace this SPD, contact the Fund Office for another
copy.
The Board of Trustees reserves the right to amend, modify or terminate
the Plan (in whole or in part) at any time and for any reason. If the
Fund documents or the Plan are amended, modified or terminated, you, your
dependents or any other individuals eligible to receive benefits under
the Fund may not receive benefits as described in this SPD. In no event
will you become entitled to any vested rights under this Plan.
No local union officer, business agent or employee, employer, or employer
representative, association representative, or individual Trustee may
speak for or on behalf of this Fund, or commit or legally bind the Board
of Trustees of this Fund in any matter whatsoever relating to the Fund,
unless such person shall have been given express authority from the Board
of Trustees to act in such matter. Statements by the Fund Office, whether
oral or written, cannot modify the benefits described in this booklet.
All inquiries, requests for ruling, interpretations, and decisions must
be directed to the full Board of Trustees in care of the Fund Office.
Please be sure to keep the Fund updated regarding any changes affecting
you or your dependents, such as any changes in marital status, address,
employment status (e.g., eligibility for Workers’ Compensation,
disability, etc .) or beneficiary designation.
This booklet contains a summary in English of your rights and benefits
under the Local 805 Welfare Fund. If you have difficulty understanding
any part of this booklet, or in filing a claim, contact the Fund at 44-61
